In term of providing web hosting services to our customers, with a very high standard and equitable for all, we established some policies.
BY SUBSCRIBING TO Les Services internet eComm-media Inc. Services YOU ACCEPT THE POLICIES LISTED IN THIS DOCUMENT AND ACCEPT TO RESPECT THEM without any restriction.
- The customer or the authorized representative of the customer (if the customer is a company) certifies 18 old year be and more.
- If the customer is a company, the person contact certifies to being a representative authorized by the enterprise in question.
- The customers agree to use web hosting services only at the legal purposes in accordance with the laws applicable to Canada and in the origin country of the customer (according to the most severe laws between the two countries).
- No contents for adults, pornographic, paedophiles, racist groups, terrorist, pirate or any other contents considered to be illegal will be tolerated on Ecomm-media server. The customer will be at risks to be sue in justice by Ecomm-media and/or by the authorities if is taken to lodge contents considered to be illegal on the Ecomm-media server.
- The customer will agree not to published, on the Ecomm-media server, any contents that will violate the laws of copyright, marks deposited, patent or all other right of ownership intellectual Canadian and international. The customer affirms being in measurement to prove that he holds the rights on the contents published on his site.
- Sending email not requested (Spam) sent by the intermediate of our system is strictly prohibited. The customer taken to send mail not requested will see his account closed in the 24 hours following the fault. All dependent of the serious of the wrong caused by his illegal acts, the customer could be prosecuted.
- In the event of calling into the question of Ecomm-media in connection with any illegal act carried out by the customer, the customers agree to show and affirm that is the only person in charge for his acts.
- The customers agree not to exceed the total of bandwith envisaged in its contract. If he exceeds the total envisaged, Ecomm-media.net will bill the customer according to fee envisaged in the plan (such as definite on Internet site d'Ecomm-media with the www.Ecomm-media.net).
- The payments are due by the customer as the reception of their invoice. Expenses of payment late of 2% per month are eligible. If the payment is not received in the 30 following days the date of invoicing, the ftp access with the server will be stopped until the reception of the payment. The monetary penalties registered on the invoice will applied. If the payment is not received in the 45 following days the date of invoicing, the service will be completely stopped without warning. If a payment is turned over by the bank with the mention "No fund", expenses of 25$ will be imposed by Ecomm-media. Additional clause the defect to pay on behalf of the customer, Ecomm-media will be able to remove without notice all the files present on the server and to close the account of the customer to allow utilisation of space disk by another customer. If the customer wants to reactivate his account, 40$ will be charged to the customer in more of any payment which had in the past and not yet paid.
- When the customer chooses the monthly billing invoicing, there has no fixed contract. The contract is continued until a written request is send by the customer to the address below. If the customer takes a contract of 3, 6 or 12 months, the customer cannot cancel his contract nor to obtain a refunding. The long-term contracts have as favours to ensure that you’re not receiving any raise in your price during all the duration of the contract if you do not change a plan. Moreover, the contracts give you a substantial reduction all depend on the selected duration. At the end of the contract, this last is automatically renewed for another identical term. The customer will have however 30 days as from the date of reception of the invoice, to cancel the renewal. Not to renew, the customer must make the request with the address below:

- The web hosting contracts are payable in advance for the totality of the term chosen by the customer.
- The customers agree to maintain his electronic email address active for all the duration of its plan with Ecomm-media. If the customer changes is email, it must warn Ecomm-media by email via the form available while clicking here as soon as possible.
- The customer agreed to carry out in writing any change address as soon as possible with following address:

- The invoicing is carried out by Ecomm-media in Canadian dollars. It is however possible to see an equivalent of our tariffs in US dollars and euro on our site. The customer is responsible to provide the payment due within the times prescribed in this agreement and on the invoice.
- Even if the web hosting account is not used, the customer have to pay the applicable monthly fee.
- The customer has 30 days starting from the opening of the web hosting account to cancel his web hosting plan and to obtain a complete refunding. The cancellation requests must be presented in writing at following address :

- The web hosting plans provided by Ecomm-media allow utilisation of scripts cgi, ASP and others. As these scripts use many resources systems, of the restrictions applied: Scripts must use acceptable resources systems. Scripts requiring a very great number of cycles of CPU and a very great space of memory RAM are prohibited. Scripts used should not in no case interact with the configuration of the server or the material. The systems of rotation of banner other than for your own site are prohibited. The systems of public meters and all other scripts being able to be used on other web sites are prohibited. Scripts of discussion in Perl are prohibited.
- The customers must use server smtp provided by their own Internet supplier to send their emails.
- Because of the instability of Internet network, in no case Ecomm-media guaranteed to the customer a continual service during 100% of time but well 99.9%. Ecomm-media will do all that is in its capacity to ensure the correct operation of its service. Ecomm-media could not be held responsible for any damage caused by interruption for its service or for access speed with its service, since several specificities of Internet network do not make it possible to obtain this kind of guarantee.
- Ecomm-media cannot be held responsible for any caused damage with the data lodged on its server. That includes but nonexclusive, the loss of data, the corruption of the data, failure of performance, temporary interruption of service. It is responsibility for the customer always to keep a backup copy of the data lodged on Ecomm-media server, elsewhere than on the aforementioned server.
- The antivirus services Ecomm-media can be activated or decontaminated by the customer starting from interface of teh hosting management. The Ecomm-media antivirus services cannot remove the already existing viruses on computer of the customer. As it is impossible to detect and to disinfect 100% of the viruses because of several unverifiable factors and none system can be praised to do it, Ecomm-media is not offering any guarantee and can be held responsible for the infections undergone by its customers. It is recommended always to be attentive and careful when you receive and read emails.
- Ecomm-media gives itself the right to finish any web hosting contract without having to provide the reasons. In this case, Ecomm-media will refund the customer of the paid amounts including the unutilised period of the month in progress.
- The customer agree to pay in Ecomm-media reasonable expenses, including but nonexclusive, the agency fees of collection and lawyer, incurred by applying his rights under these terms and conditions.
- The customer agrees to compensate Ecomm-media if he contravenes one another of the articles of these terms and conditions.
- Ecomm-media reserves the right to modify the web hosting plans without notice. Ecomm-media can remove, modify or add options to the current web hosting plans without notice. Additional clause the withdrawal or the modification, or several options of its web hosting plan, the customer will have right to finish his web hosting plan and to receive a refunding for the unutilised period, including for the month in progress (apply only if it has a withdrawal or modification there).
- Ecomm-media can modify the fee charged for the various web hosting plans in any time without notice. The customers having a 3 month old contract and more will not be affected by the change of the fee for the already paid period. For the 3 month old contracts and more, the new fee will be applicable at the time of the renewal.
- Ecomm-media reserves the right to maintain a price different and to offer web hosting plans different for certain customers for one period from time given for some reason that it is. That will be able, in no time, being interpreted like abandon by Ecomm-media of the rights and responsibilities described in these terms and conditions.
- Ecomm-media reserves the right to modify these terms and conditions constantly without notice.
- The customer accepts that the address of its site is used by Ecomm-media for ends of promotion and reference to prospective customers.

- The use of the Ecomm-media services confirms your acceptance of these terms and conditions in any time
- These terms and conditions are governed in agreement with the laws of the province of Quebec
- Any litigation concerning these terms and conditions will be treated with Quebec according to laws' of the province of Quebec.
- All the taxes applicable to the services provided by Ecomm-media will be added to internet hosting fee for the residents of Quebec and Canada.
